We would like to thank those members who attended the SAPPF AGM on Saturday, 20 July 2024. It is essential and encouraging to receive feedback, support and comment from our members as we strive to make a positive change in the healthcare landscape.

At our AGM we welcomed the new SAPPF Board of Directors for the next two years.

With the new SAPPF MOI being recently adopted, this now automatically allows any group with 100 or more members to nominate a director appointed to the board. We look forward to building and growing SAPPF with the input and valued support of the board.

SAPPF would like to extend our gratitude to Yatish Kara for his vital role in SAPPF. Yatish has been a SAPPF board member from the outset of SAPPF in 2008 and served as SAPPF chairman for 5 years from 2017. As Yatish steps down as a board member we thank him for his exemplary dedication to SAPPF and wish him all the very best.


Certificate of Need Judgment

SAPPF joined Solidarity as the third of eight applicants to challenge the constitutionality of the Certificate of Need (CON) scheme as set out in section 36-40 of the National Health Act 61 of 2003. The CON scheme required both healthcare service providers and facilities, to apply for a CON which would restrict their choice of where to practice The Certificate would be valid for a period of twenty years. Failing to be in possession of a Certificate within two years of implementation would result in potential criminalisation. Sections 36-40 of the National Health Act have not been promulgated. The court action was triggered by the publication of draft CoN regulations in 2020.

On Wednesday, 24 July 2024, Judge Anthony Millar of the Pretoria High Court ruled the controversial Certificate of Need to be unconstitutional and the matter has been referred to the Constitutional Court for confirmation.

It was ordered that sections 36-40 of the National Insurance Act 61 of 2023 are invalid in their entirety and are severed from the Act.

SAPPF welcomes this ruling and is encouraged by the fact that this ruling supports our views that the CoN scheme is unconstitutional. Since many of the constitutional concerns in the CoN are similar to those in the NHI Act, We are confident in our decision to legally challenge the NHI Act.
